JURY WAS SELECTED TO DECIDE WITH THE HEART BUT DECIDED ON LAW
There are internal and external circumstances that influence the decision of a jury. Basically jurors take into account the evidence, the methodology used by the defense attorney as well as by the prosecutor during the process, but also emotional forces, and even political tendencies, play a strong role in a Jury’s final decision.
The prosecutor knew in advance it would be difficult to deny the elements that shape the characteristics of the legal figure Self- Defense, so selecting mothers with children to obtain a sentimental verdict, would have been one option to obtain a potential convicted verdict against the defendant.
Deciding a judicial case based on sentiments contrary to the law is immoral. If this would have been the system of justice, it would not have been necessary to establish laws.
MANSLAUGHTER TRANSACTIONAL SOCIAL FORMULA
The inability to destroy the argument of Self-Defense, was ratified, when in the middle of the process, the Prosecutor asked the judge to change the charges, adding a lesser punishment called Manslaughter, as a transactional formula, which was considered a political solution by the majority of Americans.
An impartial judge in an independent process would have declared a mistrial at that moment.
Jury refused the proposal of punishing Mr. Zimmerman with a minimum sanction as a transactional formula, as was suggested by the press and different social organizations. Justice could adjust sanctions according to the Law, but could never use different degrees of punishment as a method to solve political o racial conflicts.
Almost all legal professors and expert jurists in criminal law, and the Media, which from outside were grading the sanction for Mr. Zimmerman, concluded that the Prosecutor had lost the case.
JURY DECIDED BASED ON LAW, NOT WITH THE HEART
The Prosecutor was wrong in diminishing the value, the strong personality, the culture, and the autonomous decision-making power of the American women.
Six American mothers had the courage to absolve Mr. Zimmerman, an indicted person alleging self-defense in a homicide, based on law, rejecting political and racial intimidation that were surrounding the case, and much more important, overcoming their own maternal feelings that could potentially influence their decision.
The Jury decided the case based on evidence and also on common sense as the Prosecutor asked them to do.
Self Defense, is not an American Civil Right; it is a natural universal right, stipulated in the criminal legislature of all countries of the world.
DECISION WITH JURISPRUDENTIAL EFFECTS. Everybody received a lesson.
This small group of mothers set up national jurisprudence, similar to those sentences pronounced by the Supreme Court.
Their jurisprudence:
They did not allow strange factors and external influence, as powerful they were, to make their decision.
They did not submit their decisions to legal transactions to avoid violence which was assumed would happen, and happened, as result of their decision.
They set up a national doctrine for the respect and the autonomy and independence of the American Judicial System.
They guaranteed the right to protect the neighborhood watch system.
They guaranteed the universal Right of Self Defense against potential aggressors
They guaranteed the right to use weapons to defend your life and your property, according to the Second Amendment of the Constitution.
PHISYCAL CONFRONTATION. Juror # B37, concept.
Juror #B37“also believed Trayvon Martin’s action contributed to his death.. by not walking away from the confrontation”, the juror said of Trayvon: “ I believe he played a huge role in his death, ( Anderson, CNN) .
Trayvon was younger but stronger, several inches taller. There was not proportion between the attacker and the passive subject. If Zimmerman had not had a gun, Zimmerman would have been the dead person, and Trayvon would have been the defendant. It is certain that Trayvon would have been acquitted based on Self defense.
In conclusion, paraphrasing juror B37, the “moraleja” is very clear. Parents are finally responsible for the success or failure of their children. Trayvon, a young man without a specific residence, wandering from place to place, needed advice, help and love, denied by his divorced parents.
Teaching children to avoid verbal conflicts is a wise advice of Juror B37. Verbal conflict generally leads to physical confrontation and a potential tragedy.
